Terms & Conditions of Use of the Harbour Park Online Store

 

These Terms and Conditions (“Online Store Terms”) apply to all transactions concluded with you, the customer, when you shop via the Harbour Park website (“the Website”) and the online store (“the Online Store”). References in this document to "the Online Store" refer to the Harbour Park online store at https://harbourpark.digitickets.co.uk operated by DigiTickets for Harbour Park.

 

Please read these Terms and Conditions carefully before placing your order and print a copy for your future reference. By registering at the Online Store you accept and agree to be bound by the Online Store Terms and the Terms and Conditions of Use of the Website which together shall constitute the entire agreement between you and Harbour Park.

 

Harbour Park reserves the right to alter these Online Store Terms from time to time.

 

Applicable laws may require that some of the information or communications we send to you should be in writing.  When using our site, you accept that communication with us will be mainly electronic.  You authorise us to contact you by e-mail or provide you with information by posting notices on our website about your order.  For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.  This condition does not affect your statutory rights.

 

These Terms and Conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract.

 

The Online Store Terms are subject to English Law and the exclusive jurisdiction of the English courts. If any Online Store Term shall be deemed unlawful, void or for any reason unenforceable then that Online Store Term shall be severable and shall not affect the validity and enforceability of the remaining Online Store Terms.  A person who is not a party to these Terms and Conditions or a contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

 

Acceptance of orders

 

Orders taken through the Online Store are currently collected from Harbour Park at The Gift Hut only. This includes all “product” items in the Online Store, all “Tickets” items and “Annual Passes”.

 

Harbour Park’s processor validates the order and credit or debit card details you submit to us before your order can be accepted. Once that has been done, Harbour Park will confirm that your order has been received by sending an e-mail to the e-mail address you provide in your registration form. The confirmation email will include your Order ID Number which will need to be brought with you on collection of your order from The Gift Hut.

 

When you confirm your purchase, you are accepting that these Terms and Conditions form the basis of any contract between Harbour Park and yourself.

 

By placing an order through our site, you warrant that you are legally capable of entering into a binding contract.  Our confirmation of your order brings into existence a legally binding agreement between us.  Harbour Park accepts all orders for products and services subject to availability.

 

Harbour Park accepts payment by most major credit and debit cards. Payment will be debited from your account before the collection of your purchase from The Gift Hut. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer and Harbour Park online store provider. Harbour Park will not be liable for any delays to your order this may cause. If the issuer of your payment card refuses to authorise payment to us or you fail our security checks, Harbour Park will not be liable for any delay or non-collection.

 

The products will be your responsibility from the time of collection but ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products.

 

Availability of Products

 

If Online Store products become temporarily unavailable, Harbour Park shall hold your order until Harbour Park has the product back in stock and will then notify you. In the event that an individual product becomes permanently unavailable then Harbour Park will seek to offer you a suitable alternative or give you a full refund.

 

Colour Reproduction

 

Harbour Park has made every effort to reproduce colours in the Online Store as accurately as possible. However, different computers reproduce colours in slightly different ways, and so exact colour matches are not yet possible over the internet. This means that when you order products from the Online Store, colours may differ from what you see on the screen. If you are not satisfied with the colour of the product you have ordered, Harbour Park operates a returns policy (see "Returns Policy" below).

 

Prices

Harbour Park operates scheduled pricing meaning that low season prices (or blue days on the colour co-ordinated calendar) cost less than the off peak and peak season prices (yellow and green days respectively). 

 

When you book online you are asked to select your visit day and are charged in accordance with the “colour” of day you intend to visit.  Should you need to amend your booking date please email Gift-Hut@harbourpark.com  and we can change this for you.  Should you move to a date that attracts a different price you will be either refunded or charged the difference on the card used to make the booking. 

 

Should you arrive/attend harbour park’s Gift Hut in person not on the date of your booking we will endeavour to move your booking to the day you are visiting.  However if the date you visit does not match the price for the date you booked either a refund or a charge for the difference will be made, normally on the card with which you made the booking prior to issue of tickets, wristbands or products.  Should you no longer wish to visit due to a change of date a refund will be made to the card that made the booking only.  Once a refund has been given the online pricing is not then available to you on the day if you change your mind and wish to purchase tickets, wristbands or products.

 

Prices are inclusive of any applicable taxes and there are no surcharges whatsoever.

 

All product prices include Value Added Tax (“VAT”) where applicable. These may change in line with UK government, Customs and Excise, EU directives, and other legal interpretations issued by relevant authorities. Promotions and prices you see in The Gift Hut do not necessarily apply to the Online Store, and vice versa.

 

Harbour Park reserves the right to amend any advertised prices without any prior notice and at any time and the right to add or withdraw any product at any time.

 

Once purchased online, tickets may not be used in conjunction with any other offer. No ticket may be resold.

 

Any discounts or offers online are available for limited quantities and periods only and shall not be available on bookings made by phone or in person.

 

To the extent that Harbour Park is permitted by law to limit our liability to you in connection with any order, that liability will not exceed the total price charged for the relevant product(s).

 

Collection

 

Your order will normally be ready for collection the day after the day the order is placed or on the day requested during the order process. Harbour Park makes every effort to have your order ready within these timescales, however, some delays may occur. Harbour Park shall not be liable for any delay that you may suffer in this regard. By placing an order you are authorising Harbour Park to share your personal information with third parties who are employed by Harbour Park to fulfil your order or satisfy our obligations to you.

 

Cancellation/Returns Policy

 

Harbour Park has the right to cancel any order you make for any product if you fail our validation or security checks. In certain instances, you may not receive email confirmation of an order being cancelled. If payment has been processed, you will receive a full refund.

 

You have the right to cancel any order you make for any product purchased through the Online Store for a full refund. If for any reason you are not satisfied with your purchase from the Online Store, return it to us within 14 (fourteen) days of receipt in an unworn/unused condition for a full refund or exchange. If you wish to exchange or return any product while complying with these terms, then please return the product to The Gift Hut with proof of purchase at: Harbour Park Gift Hut, Arun Parade, The Seafront, Littlehampton, West Sussex BN17 5LL 

 

Up to 30 days after purchase of a product you can ask for a refund, with proof of purchase.  We will usually offer a replacement of the product or a refund as long as the product is not of a satisfactory quality, fit for purpose or as described.

 

However, if you have purchased ‘services’ from the Tickets section or Annual Passes and they have been partially used, these are not refundable. Please see separate Ts & Cs for these items by clicking on the links below:

Party Bookings

 

Deposits for securing party slots are taken on a non-refundable basis.  Should you need to cancel your party we will endeavour to move your booking to a different available date/time slot without extra charge.  Should Harbour Park, due to circumstances beyond our control, not be in a position to host your party we will notify you as soon as possible via the email and/or phone number you gave with your booking.  We will endeavour to move your booking to a different, mutually agreed, available date/time slot without extra charge.

 

 Credit and Debit Card Security Assured

 

The credit and debit card payments through the Online Store are managed by SagePay.  All online orders will be secured with the levels of encryption provided by SagePay. When you enter your personal details in the checkout pages of the Online Store you are in a secure website.

 

Transactions also require the use of the security code (CV2) number from the back of your credit or debit card. This information is only available with physical access to the card and is not stored by the website
